Takaful construction insurance aims to cover serious defects in a building after handover, over a long horizon, through a mutual fund built on donations; in France, the legal duties of decennial and structural damage cover apply whatever model is chosen.
A risk that lasts long after handover
Unlike most annual covers, construction insurance protects a building for many years after its acceptance. Structural cracks, water ingress and subsiding foundations often appear late, which forces the fund to keep durable reserves throughout the guarantee period.
Decennial and structural damage cover under French law
In France, the 1978 Spinetta law requires builders to insure their ten-year decennial liability and project owners to take out structural damage insurance, known as dommages-ouvrage. A Sharia-financed project is not exempt: any takaful solution must meet these Insurance Code obligations.
Why a donation contract rather than an exchange
The doctrine followed by takaful operators holds that exchanging a premium for an uncertain payout involves excessive gharar. Instead, the project owner pays a tabarru' contribution into a common fund, where uncertainty remains tolerable because the purpose is mutual help.
The participants' fund over a ten-year horizon
The IFSB-14 standard separates the participants' risk fund from the shareholders' fund. For construction, this fund must remain solvent throughout the guarantee period, which calls for prudent reserving and compliant investments that are liquid enough to pay claims.
Qard hasan: the operator's advance
If a run of structural claims exhausts the reserves, the operator advances a qard hasan, an interest-free loan. It is repaid only from later surpluses, so the burden is spread over several financial years instead of penalising a single generation of participants.
When is the surplus of a construction fund known?
The result of an underwriting year can only really be measured once the guarantees have expired. A prudent operator therefore waits. In Malaysia, the Bank Negara Malaysia framework caps at 50% the share of a surplus that the operator may take.
Permitted investments for long-term reserves
The reserves of a construction fund can be invested in real estate, Islamic banks, sukuk or compliant shares. Companies earning their revenue from alcohol, tobacco, pornography or weapons are excluded, along with any product that bears interest.
Developers, private owners and social landlords
Needs differ by project owner: an individual building a family home, a developer selling off-plan, or an association building a place of worship. For the last case, see also our page on insuring a mosque, which covers the specific points involved.
What is actually available in French-speaking Europe
No takaful operator offering decennial cover has been identified in France, Belgium or Switzerland, where neither the ACPR nor FINMA has taken a position. What remains is a conventional contract, whose clauses and investment policy should be examined closely.
Islamic financing of a property project
When a purchase or construction is funded through murabaha or ijara, the bank often remains the owner and requires the building to be insured. Insurance duties must then be clearly split between bank and client, as with Islamic property insurance.
Sharia governance of a long-term guarantee
The IFSB-8 and IFSB-10 principles, adopted in November 2009, govern takaful undertakings and their Sharia supervision. For construction cover, check that the Sharia committee reviews the fund regularly and not only when the product is first launched.
Retakaful for large structures
A high-rise building or public infrastructure project exceeds the capacity of a single fund. The operator then cedes part of the risk to a retakaful fund under the 2016 IFSB-18 principles, in which operators pool their risks together.
Covering a construction project with takaful
- Define the building, its total cost, its intended use and the list of contractors subject to compulsory decennial liability.
- Check with the local regulator that the takaful operator is licensed and authorised to cover construction risks.
- Request the Sharia committee's fatwa and a description of the model, wakala, mudaraba or wakala-waqf, applied to the construction fund.
- Examine the operator's fee, the length of cover, the surplus distribution rules and the treatment of any qard.
- Where no takaful offer exists, take out the compulsory covers with a conventional insurer and review its clauses with an adviser.
- Report any defect as soon as it is discovered, with photographs and a written record, within the deadlines set by the contract.
Price components of construction cover
| Item | Function | Factors affecting it |
|---|---|---|
| Tabarru' contribution | Builds the project owners' mutual fund | Building cost, construction method, ground conditions |
| Wakala fees | Pay for management and underwriting | Contractual rate, project size |
| Long-term reserve | Ensures solvency over the full period | Length of guarantees, past claims |
| Retakaful share | Protects against very large losses | Building height, market capacity |
| Deductible per claim | Portion borne by the insured | Chosen amount, type of defect |
Documents requested from the project owner
- Identity document or company registration of the project owner
- Building permit and plans
- Soil survey and technical inspector's report
- Decennial insurance certificates of the contractors involved
- Detailed budget and works schedule
- Murabaha or ijara financing contract if a bank is involved
- Title deed for the land
Pitfalls to avoid with construction cover
- Dropping structural damage insurance on religious grounds without an alternative, even though the law requires it and defects can block a later sale.
- Accepting a product labelled Islamic without a named Sharia committee or a written fatwa that specifically covers the construction guarantee.
- Assuming a surplus will be paid every year, when a ten-year risk only shows its result once the guarantees have expired.
- Ignoring whether the Islamic bank or the client must insure the building during an ijara financing arrangement.
- Neglecting the contractors' decennial certificates, which leaves the project owner alone against defects if a contractor fails.
Common questions on takaful construction
Is decennial liability compatible with takaful?
In principle nothing prevents a mutual fund from covering decennial liability, but no takaful operator licensed in France has been identified for this risk. In practice, builders insure with a conventional company to meet the legal requirement.
Can a Muslim private owner do without structural damage insurance?
No, the obligation falls on the project owner, even an individual. Going without it causes problems on resale and removes quick advance funding of repairs. Religious questions are better settled by consulting a scholar on the contract chosen.
Why do surpluses take so long to appear?
Because covered defects can emerge years after handover. The operator must hold reserves until the end of the guarantee period before recognising a surplus, then share it among participants according to the contractual formula.
Who checks the compliance of a construction fund?
The operator's Sharia committee approves the product and its investments, while the national regulator monitors solvency. In Pakistan, for example, the SECP requires an annual Sharia audit in addition to the financial audit.
